If you don’t care about the takings clause of the US Constitution, sure, let’s set up free usage without compensation to the private operator on the strength of a Governor’s signature. Oh, and can I have a pony with that?
There’s a good case to be made for sorting out what would be fair in case of emergency ahead of time but “free” is not fair when the operator has to dig into his own pockets to pay for the consequences of somebody else’s foul up.
